Description of the incident:

I initially wasn’t planning to contest this note, but after Grim’s (and I think bios) suggestion, as well at the notes use in another situation, I’ve decided to appeal. Below are the key issues I have with the note:

1: Note shows incorrect information at best as well as limited information on a note, at worst, shows limited investigation and disregarding of context…
2: The note goes against current rules and historic rules against killing fresh spawns
3. The judgement is a stretch even without the fresh spawn rule, I had the ability to kill the brand new, fresh spawn private, however decided to spare them and threaten them after. (Punishing me for not outright wordlessly decapping someone on their first round, is akin to arresting a Private for accidentally firing a gun in briefing, even the most cold-hearted MP doesn’t do that even though they technically should)

So, I was hostile CLF, I can’t recall the specifics beyond the fact I killed a few marines at FOB, got revived on colony, (maybe broke free again, got killed, revived on colony), I believe I traded some RP with the PO/marines, and was moved on to DS1.

It eventually launches, and the PO and another officer fumble with the transfer, opening the door after we landed and somehow letting me out, doors are somehow all unlocked, so I escape deep in to the ship, untie myself.

I can hear on comms or something akin to that that the MPs are on a big manhunt. I slink around the ship, and get into the prep, I’m now armed, I got guns from the floor.

I see a marine come in, he doesn’t notice me, I could have slotted him and planned to as I thought it’s only a matter of time till he sees me and shots out, but he hasn’t yet, an easy mark, I went up with the shotgun, examined him and - he’s a private.

I can’t remember the specifics but he’s actually one who talks to, but is clearly new, so I tell him to vend me ANOTHER of the weapons he had in his hand (MK2, which is what I was originally considering killing him to obtain) and then I threaten him and say something akin to “You do not know how FORTUNATE you got today!” or something along those lines, the MP manhunt continues, I’m trying to find a fax machine to do my usual, and as I’m just about to find him, an MP and I run in to each other, point blank.

We both draw our weapons (I can’t remember if he had a lethal or not) but I take him down (We’re also around 3-4 tiles around from each other) I kill him and drag him in to maintenance (about 4-5 steps away). Around this time, a marine stumbles across me and starts firing on me, hitting me a few times iirc, so I fire back, and when he backs off, I believe I shot the MP a handful of more times, to make his revival take longer, and it decapped him (Should have kept the armoured berets in).

The MPs continued to hunt me down and I think I was killed by some marines and decapped myself. (Being decapped as a CLF survivor happens about 60% of the time)

This isn’t concrete but I also believe I was told that the note was more for “record” rather than a warning, (however I may be misremembering this specific part), and found it almost like an amusing legacy like my old note for hitting Apop with a baton which stunned on every other server except CMs (which cracked his head open) or the old CE ban (Promised myself not to lift this until CE actually has things to do, rip) from 2016/17 for making another medical bay near the old evac.

So, to reiterate, I could have killed the new player, but killing fresh spawns is not allowed, and I also didn’t want to kill a brand-new player on his first round (because if I do that, he’s almost certainly not coming back, and new people are legit the soul and lifeblood of CM)

TLDR - Shipside rule tells me not to kill fresh spawns, Survivor rule tells me to kill USCM, I choose a middle ground with a bit of RP, so I get try avoiding breaking both rules without punishing new player and get an inaccurate note for it.

Logs - Both written logs,
New players Ckey
Combat logs (you can work out how close MP and I when we both ran into each other to show how sudden it was)
Previous rulings on shipside killing (I remember this because we even considered using turrets to protect fresh spawns in cryo and prep at one point)

From what I recall of this, as it happened over a month ago, this was a note for not being consistently hostile as CLF. A note, just for future reference in the unlikely case it came up again. But without a note we can’t accurately track any issues that may or may not be cumulative.

Can’t say anything else on the matter really, it’s been so long that I don’t remember the full context so logs will need to be delved to judge.
