Description of the incident:

MT Jim ‘Jam’ Miller was arrested by myself for several charges; Damage to government property, Contraband, and resisting arrest, for trying to break into the XO’s office with a MAC-15 in hand. Jim requested an appeal from the CO for the contraband charge. While we were appealing it, I opened the cell door to pass them the appeal form, upon which they ran to the table in front, to grab an unloaded MAC-15 which I had placed there as evidence, all of this in front of the CO. While they did not grab it, I saw it as a textbook case of jailbreak, and thus applied the new charge, and moved them to the perma cells. Jim then requested an appeal for the jailbreak charge, as they were “Just showing an example” of how they could easily break out, or something of the sort. What is most relevant to this report, is that the CO Cazz Khada agreed with this, and said they would pardon them, despite my voiced concerns, and were still considering pardoning the contraband charge, until I clarified that they were charged for possession of it, and them dropping it to the ground when I saw them isn’t enough to pardon or appeal them. Even after this, they had to be arrested as they were getting redressed, as I realised that they were wearing the XO’s windbreaker, and had in fact managed to get inside and steal the jacket, so I added a theft charge.

Cazz Khada pardoned the MT of Jailbreak saying “I will drop the jailbreak charge, he was obviously just being passionate in his case of defending his innocence”.

I find this line of reasoning very questionable for a pardon for several reasons:

  1. Innocence isn’t strictly why you pardon someone, since by taking a pardon, you admit that you did the crime.
  2. At no point was the MT showing remorse for their various crimes.
  3. Jim was one of three MT’s awake at this time, along side several comtechs, he was not critical to the marines in any way.
  4. Jim ran out of their cell, in direct view of the CO.
  5. Jailbreak is a capital crime, and cannot be pardoned without HC’s direct permission.

I should also note, that unless I’m misremembering, Cazz did not announce the pardon to officialise it, which is required under the CO code of conduct.

Evidence:

The only screenshot I took during the round, was a fax I sent to the provost during the round. The round logs should show what me and the CO were discussing.

Hello, to add my input and perspective.

This all was happening during a hectic phase of the operation, I was called to the brig for the appeal in which upon my arrival I was shown a completely blank form. As Jim was not even given it until that point. As for the charge of jailbreak, he was out of his cell for about 2 seconds, and didn’t even do anything. No grabbing, no interaction, both MP’s present in the room did not even react in time till he was back in his cell. I do not remember the exact wording but it was about “showing an example for the CO” about procedures and safety. After which I rolled my eyes and told you both to not waste my time with an unfinished appeal because I was in middle of leading an operation at that time.

After a sizeable amount of time has passed I was called back into brig for the finished appeal. To which is when I learned the prisoner was jailed for jailbreak. I grab the appeal, which was still in the perma cell. When even then, it was half filled out with only his side of the story. Which stated how he found the mac-15 in middle deck and was searching for a MP. Upon finding one, he tossed it to them and walked away when he was arrested. Meanwhile I had to then question who was the arresting officer and their side of the story, as the arresting officer side of the form was empty. In which I was given more context. Because initially I was ehh on how harsh the book was being thrown at him from his side of the story, only after I had to sit there and question what happened from your perspective I agree’d to their other crimes, such as contraband. That I only said to not be overkill with the jailbreak charge. That it was less of an appeal and more of me saying that charge shouldn’t be there in the first place. As i was there to witness it first hand.

The Commanding Officer Of the Almayer has the final say on law enforcement within their operational area unless overseen by higher officials of the Provost Marshal Office or High Command.

I personally felt that effectively round removing a player of 2 seconds or less of stepping out of an open cell before walking back in on his own volition, was not needed, and as such the jailbreak charge shouldn’t have been valid in the first place. Not that his jailbreak attempt was legitimate and that it should be pardoned.

I said to release him from perma, and the side effect was that he was in jail for so long his timed charges have expired long past this point.

That was when I pointed out he actually had the XO’s windbreaker for you to apply a theft charge, giving him more time in a cell.

As such I didn’t announce the pardoning because there was nothing to really pardon, I only said that applying the one capital crime is much. All his other crimes where justified for his sentencing. After that you said that he wishes to appeal his theft charge, but you will be faxing provost for it. Which I didn’t say anything against it.

The CO Council has overlooked this report and no action will be taken against Bourbon.

Through their own testimony and after looking through the logs, it was clear that their terminology was muddled and misspoke.

Therefore this report is being denied
