Rule 11 - Marine law, mandatory obidience

Evidence:

This round i was the ASO and handled most of the brig stuff as the captain’s delegate. It all started after the briefing was over, when command staff returned to the CIC. Talon “sodapop” Yeskey the CMP told the DP to hold the alamo, because he was trying to arrest someone but the captain gave an order to launch the ship. If conflicting orders are given the one from the higher ranking person should be followed, which is what the DP did. After the Alamo was launched i heard the CMP tell the DP through comms that they’re gonna get arrested the moment they land shipside for major insub. I was in the CIC and we did try to tell the CMP that the DP was just following the captain’s orders, but he wouldnt listen and the next thing i know is the DP asking for help on comms. The captain sent me down to the hangar to stop the CMP but by the time i got there they were already gone. I asked the blue haired DCC where they went but she shrugged, so i went to the crew manifest in medical and followed its lead to the brig. I went through the halls south of the conference room and i saw the blonde DCC, in bloody clothes limping away from the brig. One of the brig windows was also broken and the floor was all bloody. I walked in and saw the CMP bleeding and trying to buckle the DP to one of the chairs, and soon after he collapsed. I quickly called for the doctors who healed the CMP while i was talking to the warden. When the CMP was healthy again, he dropped the (false) charges against the DP and went after the DCC for attempted murder. Turns out the guy was just trying to save his colleague from being unlawfully arrested(and the CMP ruining someone’s round).

Anyways the CMP went on a hunt to find the DCC and i returned to the CIC. About 5 minutes later i heard that the DCC was taken to the brig. I told the captain that i’ll be handling the appeal as his delegate to which he said okay, I knew he didnt want to deal with the whole bullshit. I got to the brig, and the CMP was being quite slow, sitting at the police computer while setting the charges(and also later, he messed up the appeal form and we had to fill out the whole thing again. Im not saying he was trying to waste our time to keep the DCC in prison longer, but it was kinda weird and tought id add it for the record). As soon as they put the DCC in perma, we started the appeal process, ive listened to the CMP’s story and he told me this: the DCC followed him as he was carrying the DP to the brig, and the DCC threatened him with a shotgun. Apparently, the CMP shot(or gave a warning shot) the DCC who fired his shotgun in return. A firefight broke out but according to the CMP’s statement the DPP ran away soon after and after checking the evidence(the DCC’s shotgun, which was confiscated by the MP after the arrest) I found that it still had buckshot shells chambered which probably means he didnt retreat because he ran out of ammo which leads us to the conclusion that he wasnt trying to murder the CMP. This is part of the reason why i WOULD have accepted the attempted murder part of his appeal if he hadnt gone fast asleep…

By arresting someone on false charges (he was well aware that the DP recieved conflicting orders from the captain, because multiple officers told him on command comms after he threatened the DP with a major insub arrest) the CMP he round removed the DCC, removed the DP for about 10 minutes and “removed” me for about 30 minutes from the round

Not part of the incident but I’d like to add, that the primary reason i made this report(i never made a report before, i dont like reporting ppl) is because people told me, including whitelisted COs, that they had encounters with Yeskey and he is just a powertripping CMP who keeps griefing and ruining other people’s rounds and he’s been doing this consistently.

erm, it seems like the headers are offset by one line or something on both new reports. Im pretty sure I wrote everything in the right place. I didnt write anything under evidence so i hope its not that big of an issue

I checked the logs to confirm your claims about Chief MP Yeskey. First of all, I must clear that Captain’s orders, as the Battalion’s Executive Officer, don’t mix it up with ASO, comes first before Chief MP’s orders. Captain authorized Dropship Pilot to launch the Dropship, then Chief MP ordered DP to hold it. At this point, we cannot talk about Major Insubordination, Executive Officer comes first before Chief MP when it comes to chain of command. Dropship Pilot has done nothing that warrants Major Insubordination charge, simply because they followed the order of someone who comes first in chain of command before Chief MP, therefore Chief MP was wrong to charge the DP with Major Insubordination.

Following this, DCC shot Brig’s windows with his shotgun, then Chief MP returned fire and both parties were seriously injured. As a result of this incident, Chief MP charged and jailed Skyler Franks for Attempted Murder and Damage to Government Property. I don’t see any problems with it, you can’t use your gun to intimidate Chief MP, or any MPs.

I couldn’t find the log that Chief MP jailed Dropship Pilot for Major Insubordination, probably because DCC caused a gunfight. However, they detained DP. That was an unlawful detainment because of the aforementioned reasons, therefore I will issue a Note per Rule 11 to Talon ‘Sodapop’ Yeskey’s player. Report approved.
